The Loop — Loyalty Program Terms and Conditions

California Residents: The Loop may be considered a “financial incentive” under the California Consumer Privacy Act. Please review the CCPA Financial Incentive Notice at the end of these Terms. 

PLEASE READ THESE TERMS CAREFULLY. BY JOINING OR PARTICIPATING IN THE LOOP, YOU AGREE TO THESE TERMS AND TO ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE, YOU MAY NOT PARTICIPATE IN THE LOOP. 

About The Loop 

The Loop (the “Program”) is the customer loyalty program for PerfectGift.com, operated by Perfect Gift, LLC (“Perfect Gift,” “we,” “us,” or “our”). Perfect Gift, LLC is part of The Wolfe Companies, LLC. The Loop is administered through our loyalty platform provider, Yotpo Ltd. (“Yotpo”). 

These Terms and Conditions (the “Loop Terms”) apply to your participation in The Loop. They are in addition to, and incorporate by reference, the Perfect Gift Terms of Use (perfectgift.com/terms-of-use), Terms of Service (perfectgift.com/terms-of-service), and Privacy Policy (perfectgift.com/privacy-policy). In the event of a conflict between these Loop Terms and the Terms of Use, the Terms of Use control as to site access and use. In the event of a conflict between these Loop Terms and the Terms of Service with respect to the purchase, sale, or use of any product or service offered by Perfect Gift, the Terms of Service control. 

By joining The Loop, you and Perfect Gift (together with our predecessors, successors, assigns, parents, subsidiaries, and affiliates, collectively the “Perfect Gift Parties”) agree that all disputes between you and the Perfect Gift Parties arising out of or relating to The Loop will be resolved by binding individual arbitration in accordance with the arbitration provision of the Terms of Use. THIS MEANS YOU AND THE PERFECT GIFT PARTIES ARE EACH WAIVING THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS OR COLLECTIVE ACTION. 

All Loop benefits — including sparks, rewards, and any member status (collectively, “Benefits”) — are subject to availability and may be changed by Perfect Gift at any time without notice. Perfect Gift may suspend, terminate, or discontinue The Loop, in whole or in part, at our sole discretion, and may substitute a similar rewards program at any time. If The Loop is terminated, all unredeemed sparks and rewards will be forfeited with no further obligation or liability. 

We may amend, modify, or supplement these Loop Terms — including the spark earning rate, redemption structure, and any tier status — at any time, with or without notice, except where prohibited by applicable law. Changes are effective when posted at PerfectGift.com and are prospective only. Your continued participation after a change constitutes your acceptance. If you do not agree, your sole remedy is to opt out of The Loop. Perfect Gift is not liable for any value or Benefits you may lose as a result of changes to the Program. 

Who’s Eligible 

The Loop is open to PerfectGift.com account holders who are residents of the United States (including Washington, D.C.) and at least 18 years of age. U.S. residency is determined based on your shipping address. If you change your shipping address to one outside the United States (including Washington, D.C.), you will no longer be able to earn or redeem Benefits, including previously earned Benefits. 

How to Join 

Log in to your existing PerfectGift.com account, or create a new account at PerfectGift.com, and opt in to The Loop. There are no membership fees. You can opt out of The Loop at any time by emailing admin.loyalty@perfectgiftrewards.com. If you opt out or close your account: 

• You will not be able to redeem any unused sparks or rewards. 
• You will not be able to retrieve previously earned sparks or rewards if you opt back in later. 
• You will not earn sparks for purchases or actions taken while opted out. 

Earning Sparks 

In The Loop, points are called sparks. 

Earning rate. Members earn at least 1 spark for every $1 spent on eligible purchases at PerfectGift.com (each a “Qualified Order”). Sparks accrue on full dollars only — purchase amounts are rounded down to the nearest whole dollar.  

Eligible purchases. Eligible purchases include the purchase price of gift cards (including Visa® and Mastercard® gift cards issued by Perfect Gift and merchant-branded gift cards) and other products sold at PerfectGift.com, in each case at the price paid by you after any discounts. 

Excluded amounts and order types. The following are NOT eligible to earn sparks: sales tax; state fees; card-purchase, processing, convenience, or shipping fees; delivery charges; the portion of any order paid using a Loop reward, promo code, or other discount; bulk, wholesale, corporate; and any other charges or order types we exclude from time to time. Bulk orders and corporate gift orders are not eligible for The Loop. 

No double earning on gift cards. Sparks are awarded only on the initial purchase of a gift card from Perfect Gift. Sparks are NOT awarded on the subsequent use or redemption of any gift card (whether at PerfectGift.com or at any other merchant), and sparks are NOT awarded when a Perfect Gift gift card is used as a method of payment for another purchase. 

Posting and returns. Sparks will be allocated to your account within a reasonable period after your Qualified Order; they may appear as “pending” until allocated. If you return, cancel, refund, or chargeback all or part of a Qualified Order, the corresponding sparks will be removed from your account. If the removal causes your balance to fall below the level needed for a previously issued reward or tier, Perfect Gift may reverse the reward or tier accordingly. 

Redeeming Sparks 

You can redeem sparks for the following promotional rewards (each a “Reward”) on eligible purchases at PerfectGift.com: 

• 500 sparks = a $5 Reward 
• 1,000 sparks = a $10 Reward 

Rewards must be applied at the time of purchase, may not be combined with other promo codes unless we expressly permit it, and may not be applied retroactively. Only the account holder may redeem and use a Reward. 

Reward eligibility. Rewards may only be applied to an order for which the total amount is greater than the total value of the rewards; rewards may not be applied to taxes, fees, or shipping charges. 

Nature of Sparks and Rewards 

Sparks and Rewards are promotional credits only. They are not gift cards, gift certificates, electronic money, prepaid access, or stored value as those terms are defined under the federal Electronic Fund Transfer Act, Regulation E, the Credit CARD Act of 2009, or any state gift card or unclaimed-property statute. Sparks and Rewards: 

• Have no cash value and are not redeemable for cash; 
• Are not transferable, assignable, or saleable, by operation of law or otherwise; 
• Confer no property rights and are not the property of any member; 
• Are not subject to escheatment or unclaimed-property laws; and 
• May only be earned and redeemed in accordance with these Loop Terms. 

Perfect Gift does not charge dormancy, inactivity, service, or maintenance fees against your spark balance or any Reward. 

Spark Expiration 

Sparks expire 12 months from the date they are earned. This expiration period applies only to the promotional sparks issued under The Loop and does not apply to any Perfect Gift gift card you may have purchased. 

Your Loop Account Is Personal 

Each Perfect Gift customer may have only one Loop account. Your account is personal and may not be assigned, transferred, or shared with family, friends, or for commercial purposes. Loop accounts and associated Benefits are not intended for those purchasing items for resale. Benefits earned on orders for resale or other commercial use are not eligible. 

Other Perks 

From time to time, members may receive additional perks (“Perks”) such as bonus sparks for completing actions (e.g., signing up, completing a profile, birthday), personalized offers, early access to promotions, exclusive discounts, or similar benefits. Some Perks may be sent by email; you will need to opt in to email from Perfect Gift to receive them. Perks may have restrictions, including expiration dates and short, time-limited redemption periods — please read each offer carefully. Perks must be redeemed at the time of purchase and may not be applied retroactively. Only the account holder may use Perks. 

Perks currently available may include bonus sparks for signing up or completing other member actions, and personalized offers based on purchase behavior and preferences. Perks that may be offered in the future include early access to promotions and new products, discounts on PerfectGift.com, and exclusive loyalty promotions. 

No redemption opportunity is guaranteed. Any redemption may be subject to its own terms and restrictions, including expiration dates. Perfect Gift reserves the right to change, add, or remove Perks at any time. Perfect Gift may also offer similar or identical perks or benefits, including participation in promotional offers or sweepstakes, to both Loop members and non-members. All Perks are promotional only and have no cash value. 

Termination and Suspension 

Perfect Gift reserves the right to terminate, discontinue, cancel, or change The Loop at any time, in our sole discretion, with or without notice. Any changes to these Loop Terms will be posted at PerfectGift.com. Perfect Gift may also suspend your Perks and/or terminate your participation in The Loop if we determine, in our sole discretion, that you have violated these Loop Terms, the Terms of Use, the Terms of Service, or our Privacy Policy, or if your account is used in an unauthorized, commercial, deceptive, fraudulent, or unlawful manner, or in a manner contrary to the spirit of The Loop (including any spark-farming or gaming schemes). If your participation is terminated, all unredeemed sparks and Rewards will become void. 

Governing Law and Miscellaneous 

These Loop Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles, and otherwise consistent with the governing-law and arbitration provisions of the Perfect Gift Terms of Use. Unless prohibited by applicable law, any arbitration will be conducted before JAMS in Pittsburgh, Pennsylvania, as further described in the Terms of Use. 

If any provision of these Loop Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Section headings are for convenience only and have no legal effect. Perfect Gift’s failure to enforce any provision is not a waiver of that or any other provision. 

Privacy and Data Sharing with Yotpo 

Personal information collected from you in connection with The Loop — including your name, contact information, account credentials, purchase history, and program activity — will be used and disclosed in accordance with the Perfect Gift Privacy Policy (perfectgift.com/privacy-policy) and Terms of Use. Account, identifying, and program-activity information is shared with our loyalty platform provider, Yotpo, solely to operate and administer the Program, including issuing and tracking sparks and Rewards. Yotpo’s use of your personal information is governed by Yotpo’s own privacy practices and the data processing terms in place between Yotpo and Perfect Gift. 

CCPA Financial Incentive Notice 

We offer incentives to customers that involve the sharing of Personal Information with us. The Personal Information collected and retained by Perfect Gift in operating these programs is described in our Privacy Policy (perfectgift.com/privacy-policy) and includes your name and contact details, date-of-birth information (if provided), payment information, contact history with us, purchase and product feedback history, additional details about you, information about your device and how you use our website, your public reviews and comments, and inferences from this data and other personal information we may collect in connection with your interaction with our service and your participation in our promotional programs. 

Benefits provided through our promotional programs may be deemed a “financial incentive” (e.g., promotional goods) and/or “differential services” (e.g., discounts, coupons, or other promotions) under the California Consumer Privacy Act (“CCPA”). The promotional programs we currently offer in connection with the collection and retention of Personal Information include: 

• The Loop. We offer sparks and Rewards to customers participating in The Loop, consistent with these Loop Terms. Participants receive promotional offers, including discounts, coupons, and opportunities to participate in other promotions. You can join The Loop by logging in to your existing PerfectGift.com account or, if you do not already have one, by registering for an account at PerfectGift.com and opting in. 
• Surveys. You may be offered the opportunity to participate in a survey. Participation may result in Perfect Gift collecting additional information from you, including your preferences, experiences, beliefs, opinions, and responses. In exchange, you may be offered a financial incentive, as described above. 
• Limited-Time Promotions. From time to time, we may offer time-limited incentives, sweepstakes, contests, or other promotions. Participation in any such promotion is governed by the applicable terms and conditions, which will describe any financial incentive. 
• Discounts. From time to time, we offer discounts in connection with a customer’s submission of an email address, phone number, or other personal information. You can opt out of our marketing emails or SMS messages at any time. 

For CCPA purposes, we treat the value of your Personal Information collected through our promotional programs as equivalent to our total program expenses (excluding the value of benefits). The value of each program is the value of the program benefits, including discounts and coupons, which depends on individual customer participation. By participating, you agree that the benefits are reasonably related to the value of the Personal Information collected and retained. 

Participation in our promotional programs is always optional, and you can end participation at any time as described in these Loop Terms. You can also contact us at admin.loyalty@perfectgiftrewards.com to unsubscribe or cancel your participation.
